TERMS & CONDITIONS OF THE ReturnT he Love CAMPAIGN INDIA

1. MasterCard India Services Pvt. Ltd. (“MasterCard”) is conducting the#ReturnTheLove Campaign (the “Campaign”) during the period from 15th November 2015 to 23.59 hours (Indian Standard Time) on 31stDecember 2015 (the “Campaign Period”).

2. The Campaign is open to the Participants (as hereinafter defined). The following persons are not eligible to participate in the Campaign:-

i. The employees (whether permanent or temporary) of MasterCard and its respective subsidiaries, affiliates and holding companies;

ii. The employees (whether permanent or temporary) of MasterCard’s promotion agencies, and other entities involved in the conduct, implementation and/or administration of the Campaign (as determined by MasterCard in its sole discretion); and
 
iii. The immediate family members of each such employee. For the purposes hereof, “immediate family members” includes spouse, parents, children(including adopted children and step-children), brothers, sisters and the spouse of the children, brothers or sisters.

3. For the purposes of these terms and conditions:-

i. “Contest Post” means the Facebook post published on the MasterCard India Facebook page (sponsored or organic) that users see in their news feed or on the MasterCard India Facebook page that is related to the Campaign. The Facebook post will have the call to action to collect contest entries to the Campaign and a link to these terms and conditions of the Campaign;

ii. “Grand Prize” and “Minor Rewards” has the meaning ascribed to them in clause 8 below; Clause 6 (ii) & 6 (iii) govern the qualification criterion for respective Prizes.

iii. “MasterCard Group” refer collectively to the group of subsidiaries,affiliates, holding companies, associated entities, whether incorporated or not as well as agencies of MasterCard;

v. “Participant” means an individual who:

- is a citizen of India or ordinarily resides in India; and
- is of the age of 18 years and above; and
- has a MasterCard card which is valid and in good standing; and
- participates in the Campaign by submitting a Qualifying Entry (as herein after defined).

Participants must begin their Qualifying Entry with “#ReturnTheLove”. By doing so, they indicate that they have read and accepted the terms and conditions of the Campaign and the privacy policy, and they give a right to MasterCard, to the fullest extent permitted by applicable law, to reproduce the whole or any part of the Qualifying Entry in its Facebook page or any other media.

but excluding the persons listed under clause 2 above.

vi. “Prizes” means, collectively, the Grand Prize and the Minor Rewards,and the expression “Prize” means any of them; and

vii. “winners” means, collectively, the winners of the Prizes, and the expression “winner” means any of them.

4. By participating in the Campaign, each Participant fully and unconditionally agrees to these terms and conditions and accepts that the decision of MasterCard regarding the Campaign and all matters related to or connected with it, including, without limitation, the interpretation of these terms and conditions, is final and binding and no queries or claims which are inconsistent with such decision or interpretation shall be entertained. In the event all or any of these terms and conditions are not acceptable to a Participant, such Participant should not participate in the Campaign, notwithstanding the offer. These terms and conditions shall be binding on the Participants.


5. To participate in the Campaign, a Participant must:

(i) Successfully submit his/her story on the Contest Post, during the Campaign Period, outlining the sacrifices made by their parents to make their wedding day memorable; OR

(ii) Successfully submit his/her story on the MasterCard India Facebook page,during the Campaign Period, outlining the sacrifices made by their parents to make their wedding day memorable, expressed through a write up, which qualifying write up shall in these terms and conditions be referred to as the“Qualifying Entry”.

(iv) Participants must begin their Qualifying Entry with “#ReturnTheLove” to indicate they have read and accepted these terms and conditions of the Campaign and the privacy policy.

(v) Entries beginning with “#ReturnTheLove” will be considered valid entries.
Participants may note that if they post the names or personal data of other people, they confirm that they have obtained the consent of such third parties to disclosethe information to MasterCard for use in the Campaign.

6. Participants must meet the following eligibility criteria in order to be eligible to participate in the Campaign (collectively the “Eligibility Criteria”):

(i) A Participant must successfully submit a Qualifying Entry during the Campaign Period in accordance with these terms and conditions. Each Participant is permitted to submit only one Qualifying Entry during the Campaign Period.Multiple entries are not permitted and any subsequent Qualifying Entry will be disqualified. In case of multiple entries by same participant on MasterCard India) page, the first submitted qualifying entry (as per recorded date &time) shall be considered valid.

(ii) Qualifying Entries must be submitted latest by 23.59 hours Indian Standard Time on 5th December, 2015 in order to be eligible to stand a chance to win the Grand Prize;
 
(iii)   Qualifying Entries must be submitted latest by 23.59 hours Indian Standard Time on 5th December, 2015 in order to be eligible to stand a chance to win the Minor Rewards;

(iv) Qualifying Entries must not contain any inappropriate, offensive, racially sensitive or defamatory language. They should also not contain any illegal content, any content over which there are third party intellectual property rights or other rights for which a consent is required from a third party or any third party brands/logos. Also, should make clear by entering/submitting the submitter is granting broad rights to MasterCard to use content. MasterCard reserves the right to remove and disqualify any Qualifying Entries which contain any inappropriate or offending content or the whole or any part of which are against MasterCard’s brand values as determined in its sole discretion;

(v) Qualifying Entries must be submitted in English as a write up on the sacrifices made by their parents to make their wedding day memorable and should not include any materials that infringe on any intellectual property rights owned by a third party; and

(vi) Participants must begin their Qualifying Entry with “#ReturnTheLove” to indicate they have read and accepted the terms and conditions of the Campaign and the privacy policy.

A Participant who meets the Eligibility Criteria shall in these terms and conditions be referred to as the “Eligible Participant”.

7. To determine the winners of the Campaign, MasterCard will identify the Eligible Participants who meet the Scoring and Evaluation Criteria. The “Scoringand Evaluation Criteria” for the Campaign is as follows:-

  (a) The Qualifying Entries of the Eligible Participants will be judged on showcasing of the sacrifices made by their parents to make their wedding day memorable  as also the parameters of creativeness, meaningfulness and appropriateness (collectively the “Judging Categories”and each a “Judging Category”) by a judging panel (“Judging Panel”). The Qualifying Entries will be ranked on scores given to them on the above parameters and other relevant factors considered by the Judging Panel in their sole discretion. The Judging Panel will consist of a representative each from MasterCard Regional Marketing, MasterCard India Marketing, and Digital Arts Network  (“DAN”) as selected by MasterCard in its sole and absolute discretion;

(a) The Judging Panel will judge all Qualifying Entries received during the Campaign Period and determine a shortlist of finalists from the top ranking Qualifying Entries determined as per sub-clause

(b) above, being the best determined to be received during the Campaign Period(“Finalists”). The exact number of Eligible Participants chosen as Finalists will be at the complete discretion of the Judging Panel. The Grand Prize Finalists will be screened with interview questions (by phone and/or email) in the order of their ranking. The best Grand Prize Finalist (based on their answers provided in the interview and their Qualifying Entry, as determined by the Judging Panel) will win the Grand Prize, provided the Eligible Participant fulfills all the conditions for the Grand Prize set out in clause 8.1 below (“Grand Prize Winner”). Any Finalist who does not become a Grand Prize Winner will receive a Minor Reward, provided the Finalist fulfills all the conditions for the Minor Reward set out in clause 8.2.

(c) In the event the Eligible Participant whose Qualifying Entry together with their interview answers is deemed the best by the Judging Panel but does not fulfill all the conditions for the Grand Prize under clause 8.1, then such Eligible Participant shall become a Minor Reward Winner, and the Finalists who is ranked next best by the Judging Panel (based on their Qualifying Entry together with their interview answers) shall become eligible to win the Grand Prize. The above process may be repeated until a Grand Prize Winner can be selected from the order of ranking of Eligible Participants; and

(d) MasterCard will award prizes throughout the Campaign Period to Eligible Participants as detailed in clause 8.2, provided the Eligible Participants fulfill all the conditions set out in clause 8.2 (who shall be respectively referred to as the “Minor Reward Winner”).

(e) In the event the Eligible Participant whose Qualifying Entry ranked by the Judging Panel does not fulfill all the conditions for the Minor Reward under clause 8.2, then such Eligible Participant shall become ineligible, and the Eligible Participant whose Qualifying Entry is ranked next in order shall become eligible to win the Minor Reward. The above process may be repeated until a Minor Reward Winner can be selected from the order of ranking of Eligible Participants.

8. There will be one (1) Grand Prize and 100 Minor Rewards to be given to the winners of the Campaign, as hereinafter detailed. Qualifying entries as per Clause 6 (ii) will be considered for Grand Prize. The Grand Prize will be awarded to the Grand Prize Winner and the Minor Rewards will be awarded to the Minor Reward Winners. The Grand Prize and the Minor Rewards are as follows:-

8.1
(a) The “Grand Prize”is a MasterCard experience for a maximum of (3) persons that is, for the Grand Prize Winner and the nominees of the Grand Prize Winner, as identified by the Grand Prize Winner in his/her Qualifying Entry (such nominees shall be referred to as the “Winner’s Nominated Persons”). The Grand Prize is valued at up to a maximum of INR 10,00,000. MasterCard will create the experience for the Grand Prize Winner and the Winner’s Nominated Persons, and will be customized around the Grand Prize Winner’s entry and story. The exact inclusions in the Grand Prize will be determined by MasterCard in its absolute discretion.
(b) The Grand Prize is subject to the following terms and conditions:-
i. The Grand Prize fulfillment period will be from15th December 2015 – 15th February 2016. In order to receive the Grand Prize, the Grand Prize Winner and the Winner’s Nominated Persons may be required to travel to a specified location on particular dates to be designated by MasterCard at its sole discretion. The Grand Prize Winner and the Winner’s Nominated Persons must both agree to and be able to travel to the specific location on the designated dates, failing which the Grand Prize Winner will be disqualified and will not be to entitled to the Grand Prize;
ii. The winner of the Grand Prize may not disclose to the Winner’s Nominated Persons that they have been nominated for a MasterCard experience, or that they are the Grand Prize Winner;
iv. The Grand Prize winner and the Winner’s Nominated Persons must sign a MasterCard acknowledgment form agreeing to, amongst other matters, the full terms and conditions in clause 10 below and the release of MasterCard from all claims whatsoever, failing which the Grand Prize Winner will be disqualified and will not be entitled to the Grand Prize;
v. Travel, if any, involved in the fulfillment of the Grand Prize will be point to point travel only, which will be arranged by MasterCard. Multi-city travel requests will not be allowed and the Grand Prize Winner and the Winner’s Nominated Persons will not be allowed to travel on different itineraries or different dates;
vi. In such case, changes to itineraries are not permitted and will only be reviewed on a case-by-case basis at the sole discretion of MasterCard;
vii. For the avoidance of doubt, all out-of-pocket expenses, spending money,meals, travel expenses, taxes, travel insurance, surcharges, and all other ancillary costs and expenses incurred by the Grand Prize Winner and the Winner’s Nominated Persons in collecting, redeeming and using the Grand Prize and each component thereof are the sole responsibility of and shall be borne by the Grand Prize Winner and the Winner’s Nominated Persons, except to the extent where specifically stated otherwise above;
viii. the terms and conditions under clause 11 below; and
ix. such other terms and conditions as may be imposed by MasterCard or the provider of the Grand Prize;

8.2 The “Minor Rewards” are prizes awarded throughout the Campaign Period to Eligible Participants whose entries the Judging Panel deem noteworthy based on the Judging Criteria. The Minor Rewards Winners will be of two categories:
(a) The Grand Prize Finalists who are not awarded the Grand Prize, who will be identified as per the Grand Prize awarding process given in clause 7 above.
(b) The Weekly Minor Rewards Winners who will be identified by the Judging Panel for every week of the Campaign Period based on the ranking of Qualifying Entries received during that week.
 
Qualifying entries as per Clause 6 (iii) will be considered for Minor Rewards.The number and the exact nature/type of prizes awarded per week of the Campaign is at the sole and absolute discretion of MasterCard are subject to the following terms and conditions:-

The types of “Minor Rewards” which will be distributed among the Minor Reward winners Gift Vouchers from reputed merchants.

Each Minor Reward winner will be awarded such number and type of Minor Rewards as are decided by the Judging Panel. Each eligible Participant can win a Minor Reward only once during the Campaign Period. However the winner of a Minor Reward could still stand a chance to win the Grand Prize;

The Minor Rewards are subject to the following terms and conditions:-

(a) Each Eligible Participant can win a Minor Reward only once during the Campaign Period. However, the Minor Reward Winner is still eligible for the chance to win the Grand Prize Subject to terms in clause 8.1 ;

(b) Minor Rewards are subject to the standard terms and conditions of individual prize and service providers;

(c) Any ancillary costs associated with redeeming the voucher are not included.Any unused balance of the voucher will not be awarded as cash. Redemption of the voucher is subject to any terms and conditions of the issuer including those specified on the voucher.

(d) All Minor Reward related communication and process must be fulfilled by the Eligible Participant by December 31, 2015; failing which the reward will stand forfeited.

9. The process for notifying and contacting winners and the claiming of the Prizes is as follows:-

9.1 Grand Prize

 (a) The Grand Prize Winner will be notified via a “reply” on the Qualifying Entry post of the Grand Prize Winner or through a direct message on the Facebook Messenger, where the Grand Prize Winner’s privacy settings in Facebook permit this mode of communication (“Grand Prize Winner Notification”); The winner will be notified on the MasterCard Facebook page where the Qualifying entry was posted.

(b)The Grand Prize Winner will be prompted to and must send a private message on Facebook (“Grand Prize Winner’s Reply”) to MasterCard India, where the qualifying entry was posted, within two (2) business days of the Grand Prize Winner Notification being sent to the Grand Prize Winner in order to claim the Grand Prize;
 
(c) If the Grand Prize Winner fails to send the Grand Prize Winner’s Reply to MasterCard India Facebook (where the qualifying entry was posted), or the Grand Prize Winner’s Reply is not otherwise received by MasterCard for any reason within two (2) business days of MasterCard India sending the Grand Prize Winner Notification, the Grand Prize Winner will be disqualified and have his/her Grand Prize forfeited and MasterCard will be entitled to award the Grand Prize to an alternative Grand Prize Winner;

(d) After receipt of the Grand Prize Winner’s Reply by MasterCard a representative of MasterCard or its appointed agency will contact the Grand Prize Winner via the contact details provided by the Grand Prize Winner to commence the booking process and finalize the redemption of the Grand Prize;

(e) The Grand Prize Winner will have twenty four (24) hours from being contacted pursuant to clause 9.1(d) above to confirm and accept the itinerary and travel details of the Grand Prize, failing which, MasterCard reserves the right to disqualify the Grand Prize Winner and forfeit the Grand Prize awarded to such Grand Prize Winner and award the same to an alternative Grand Prize Winner selected as set out in clause 7(c);

(f) To claim and use the Grand Prize, the Grand Prize Winner must travel and fully participate in the Grand Prize fulfillment program and related activities as advised by MasterCard and/or its appointed agency to receive the Grand Prize;

(g) In connection with the claiming of the Grand Prize, MasterCard shall be entitled to request proof from the Grand Prize Winner of (i) him/her being an existing MasterCard Card cardholder(Grand Prize Winner will, the winner must provide the Valid MasterCard card copy or proof of holding a valid MasterCard card) (ii) his/her valid photo identification, and (iii) his/her valid travel documentation in order for the Grand Prize Winner to redeem the Grand Prize, failing which MasterCard reserves the right to disqualify the Grand Prize Winner and forfeit the Grand Prize awarded to such Grand Prize Winner and award the same to an alternative Grand Prize Winner selected as set out in clause 7(c); and

(h) In connection with the claiming of the Grand Prize, MasterCard shall be entitled to request proof of the parents of the Winner (i) their valid identification, and (ii) their valid travel documentation in order to redeem the Grand Prize, failing which MasterCard reserves the right to disqualify the and forfeit the Grand Prize awarded to such Grand Prize Winner and award the same to an alternative Grand Prize Winner selected as set out in clause 7(c);and


(k) MasterCard or its appointed agency will inform the Grand Prize Winner from whom he/she may collect the airline tickets, accommodation booking confirmation and other components of the Grand Prize.

9.2 Minor Rewards


The process for notifying and contacting the winners and the claiming of the Prizes is as follows:-

  (a) The shortlisted Minor Reward Winners will be notified via a “reply”on the Qualifying Entry of the Minor Reward Winner or through a direct message on the Facebook Messenger, where the Grand Prize Winner’s privacy settings in Facebook permit this mode of communication during the Campaign Period or, for those shortlisted Minor Reward Winners of the last week of the Campaign Period,after the expiry of the Campaign Period (“Minor Reward Winner Notification”);The winner will be notified on the MasterCard Facebook page where the Qualifying entry was posted.

(b) Each shortlisted Minor Reward Winner will be prompted to and must send a private message on Facebook (“Minor Reward Winner’s Reply”) to MasterCard India Facebook account within two (2) business days of the Minor Reward Winner Notification being sent to the Minor Reward Winner in order to claim the Minor Reward;
 
(c) If a shortlisted Minor Reward Winner fails to send the Minor Reward Winner’s Reply to MasterCard, the Minor Reward Winner’s Reply is not otherwise received by MasterCard for any reason within two (2) business days of MasterCard sending the Minor Reward Winner Notification to such Minor Reward Winner, such Minor Reward Winner will be disqualified and have his/her Minor Reward forfeited and MasterCard will be entitled to award such Minor Reward to an alternative Minor Reward Winner selected in terms of clause 7(e);

(d) After receipt of the shortlisted Minor Reward Winner’s Reply by MasterCard,a representative of MasterCard or its appointed agency will contact the Minor Reward Winner via the contact details provided by the shortlisted Minor Reward Winner. The Minor Reward Winner has to complete the Minor Reward fulfillment verification process and finalize within two (2) business days in order to be eligible for the Minor Reward. The Minor Reward Winner must hold a valid MasterCard card on his/her name and will be asked to share his/her card number, copy of his/her photo ID; within two (2) business days. If a Minor Reward Winner fails to complete the Minor Reward fulfillment Verification process for any reason within these two (2) business days, such Minor Reward winner will be disqualified and have his/her Minor Reward forfeited, and MasterCard will not hold the responsibility to any delayed response from such disqualified Minor Reward winner.

(e) The Minor Reward Winners will have two (2) business days from being contacted pursuant to clause 9.2(d) above to confirm and accept his/her Minor Reward, failing which, MasterCard reserves the right to disqualify such Minor Reward Winner and forfeit the Minor Reward awarded to such Minor Reward Winner and award the same to an alternative Minor Reward Winner selected in terms of clause 7(e);

(f) MasterCard has full discretion on the type and tier of Minor Rewards to be awarded to the shortlisted Minor Reward Winners. MasterCard’s decision will be final and binding on all Participants;

(g) In connection with the claiming of the Minor Reward, MasterCard shall be entitled to request proof from the Minor Reward Winner of (i) him/her being an existing MasterCard cardholder (Grand Prize Winner will provide the details required by MasterCard to verify this), and (ii) his/her valid identification,in order for the Minor Reward Winner to redeem the Minor Reward. Failing due submission thereof, MasterCard reserves the right to disqualify such Minor Reward Winner and forfeit the Minor Reward awarded to such Minor Reward Minor and award the same to an alternative Minor Reward Winner selected in terms of clause 7(f); and

(h) MasterCard or its appointed agency will inform the Minor Reward Winner from whom he/she may collect the relevant components, as the case may be, of the Minor Reward.

9.3 Winner Announcement

The winners of the Prizes may be publicly announced by MasterCard in the following manner, at their sole discretion:

(a) The winners of the Minor Rewards will be announced on MasterCard India Facebook account (www.facebook.com/MastercardIndia) during the Campaign Period;

(b) The winner of the Grand Prize will be announced on MasterCard India Facebook account (www.facebook.com/MastercardIndia).

9.4 Prize Fulfillment

The Prizes and any component thereof cannot be transferred or exchanged or redeemed for cash, credit or any prizes and other items in part or in whole.The Prizes may be subject to additional terms and conditions accompanying them(if any). MasterCard may, at its sole discretion, at any time and without prior notice, replace or substitute any Prize or any component or item of any Prize with another component or item of a similar value.

Claiming procedures for the Prizes are subject to the requirements set out by MasterCard and/or its appointed Prize fulfillment agency, which requirements will be communicated to the winners.

It shall be the responsibility of the winners to contact MasterCard’s appointed Prize fulfillment agency to collect the Prizes. 

If a winner fails to collect the Prize from MasterCard’s appointed Prize fulfillment agency within two (2) business days of being notified to do so or within such other period as may be notified to the winner, MasterCard shall be entitled to disqualify such winner and forfeit the Prize awarded to such winner and award the same to an alternative winner selected in terms of clause 7(c) or7(e) as the case may be.

MasterCard and its directors, officers,employees and agents shall not be liable to the winners under the Campaign or any other person for any deficiency, delay, omission, default or failure by any person or the fulfillment agency in collecting or distributing the Prizes.

Reasonable efforts will be made to contact the winners. If any winner cannot be contacted for any reason or is unable to or does not comply with any of these terms and conditions, MasterCard shall be entitled to disqualify such winner and forfeit the Prize awarded to such winner and award the same to an alternative winner selected in terms of clause 7(c) or 7(e) as the case may be.

(e) MasterCard shall stop the dissemination of prizes by the 31stJanuary, 2016. Any requests after 31st January, 2016 shall not be entertained. 

9.5 To the extent permitted by applicable law, MasterCard may conduct background checks on all shortlisted winners and, the case of shortlisted Grand Prize Winner. MasterCard shall seek the prior written consent and such other information as may be required for the checks from each shortlisted winner. If a shortlisted winner does not authorise such background checks by MasterCard or fails such checks (as determined by MasterCard in its sole discretion), such shortlisted winner will be disqualified from the Campaign and will not be entitled to any Prize.

10. Each of the Grand Prize Winner must agree to be filmed and photographed according to the following terms and conditions:-

10.1 The Grand Prize Winner’s consent to the MasterCard Group and its respective, licensees, successors, assigns and contractors, filming or otherwise recording the Grand Prize Winner’s and his/her parent’s appearance,poses, voice and statements, and editing such recordings (collectively “Footage”);

10.2. The Grand Prize Winner, that MasterCard may use, or license others to use, the Footage or a reproduction of it, in whole or in part, and/or the Grand Prize Winner’s and his/her parent’s name, voice, likeness and any biographical material which the Grand Prize Winner, may provide, in connection with the use of the Footage, for marketing and promotional purposes, on websites operated by or for the Grand Prize Winner and in social media channels. The Grand Prize Winner, further agree that MasterCard, in its sole discretion, may edit,modify, add to, delete from or change the Footage;

10.3 The Grand Prize Winner, hereby release the MasterCard Group and their licensees, successors and assigns, from and against any claim of any kind or nature whatsoever arising from the use of the Footage, including, but not limited to, those based upon “moral rights” (which, to the extent such “moral rights” may not be assigned to MasterCard are expressly waived by the Grand Prize Winner, , defamation (including, without limitation, libel and slander),invasion of privacy, right of publicity, copyright, or any other personal and/or property rights ("Claims") and agree that the Grand Prize Winner,will not now or in the future assert or maintain any Claims against MasterCard,its contractors or their parent companies, subsidiaries, affiliates, licensees,successors or assigns; and 

10.4. The Grand Prize Winner may be required to participate in publicity programmes which MasterCard may from time to time organize in connection with the Campaign within 6 months from end of the Campaign with advance notice to the Grand Prize Winner and if so, the Grand Prize Winner, must attend such functions.
11. The travel and accommodation arrangements, if applicable as part of the Grand Prize is subject to the following terms and conditions:

11.1. Unless stated otherwise in these terms and conditions, the travel and accommodation arrangements forming part of the Grand Prize is limited to arranging for the items given in clause 8.1(a) to (e).

11.2. For the avoidance of doubt, the Grand Prize does not include:

i. Ground transportation charges from the Grand Prize Winner, address to the Grand Prize location [except to the extent where specifically stated otherwise in section 8.1(a) to clause 8.1(d) above];

ii. Insurance coverage charges;

iii. Charges for upgrades or other changes sought at the Grand Prize location;

iv. Expenses relating to undertaking excursions, visiting attractions and similar expenses relating to amusement and entertainment [except to the extent where specifically stated otherwise in section 8.1(a) to clause 8.1(d) above];

v. Any other expenses incurred by the Grand Prize Winner, These must be paid by the Grand Prize Winner ;

11.3. The Grand Prize Winner, should comply with the terms, conditions and limitations of all transport providers (including adherence to the travel itinerary) and the accommodation providers (including adherence to the check-in/check-out times and stay related terms) involved in the provision of the Grand Prize. MasterCard will not be liable to provide any alternative prize, cash equivalent or other compensation if the transport providers or the accommodation providers terminate the travel or accommodation arrangement due to the Grand Prize Winner’s failure to comply with such terms, conditions and limitations;
11.4. The Grand Prize and any component or item thereof cannot be transferred or exchanged or redeemed for cash, credit or any prizes and other items in part or in whole.The Grand Prize may be subject to additional terms and conditions accompanying them (if any). MasterCard may, at its sole discretion, at any time and without prior notice, replace or substitute the Grand Prize or any component or item of the Grand Prize with another component or item of a similar value; and

11.5. All costs and expenses incurred in collecting and using the Grand Prize are the sole responsibility of and shall be borne by the Grand Prize Winner.

12. By stating “#ReturnTheLove” at the beginning of the Qualifying Entry of the Participant, the Participant agrees:

12.1. to these terms and conditions, including terms relating to MasterCard’s liability in respect of the Campaign;
12.2. that the Participant represents only himself/herself and no other person;
12.3. that he/she is of the legal age to enter into contracts;
12.4. to provide accurate information to MasterCard ;
12.5. that the Participant will not use the Campaign to reproduce, duplicate,copy, sell, resell, distribute, publish or exploit for any commercial purpose the products or services provided by MasterCard or obtained through the Campaign without obtaining the express, prior written consent of MasterCard . This restriction includes any attempt to incorporate any information from the Campaign into any other directory, product or service;
12.6. that the Participant will not use the Campaign for any purpose that is unlawful or prohibited by these terms and conditions;
12.7. that MasterCard  accepts no responsibility for late, lost, rejected, blocked, undelivered or misdirected entries, notifications and other correspondence and Qualifying Entry transaction postings, including, without limitation, entries, notifications,correspondence and Qualifying Entry transaction postings not received due to the malfunction of any device, software application, equipment, computer,computer server or network, however described, or entries, notifications,correspondence or Qualifying Entry transaction postings which are lost in the course of transmission or delivery;
12.8. all selections and/or decisions made by MasterCard in relation to the Campaign (including, without limitation, the selection of winners) will be final and conclusive. No enquiries or complaints will be entertained;
12.9. that the Campaign is in no way sponsored, endorsed or administered by, or associated with, Facebook and that Facebook does not assume any responsibility whatsoever for the Campaign, including, without limitation, its operation,conduct, implementation and administration; and
12.10. that he/she shall not have any claim whatsoever (whether on account of any liability, damage, loss or otherwise) against Facebook in relation to or in connection with (i) the Campaign, its operation, conduct, implementation or administration; or (ii) his/her participation in the Campaign.
12.11. that MasterCard shall be entitled to feature a text excerpt from the Qualifying Entry for the current Campaign and future MasterCard marketing campaigns.
12.12. that the Participant shall have no objection to the publication,sharing, circulation and/or dissemination of a text excerpt, or extract from the Qualifying Entry posted by the Participant for any of MasterCard’s current campaign and/ or future marketing campaigns.

13. Each Participant acknowledges that MasterCard Group does not assume any responsibility for:

13.1. any Prizes offered under the Campaign;
13.2. any products and services offered under the Campaign or related to or connected with any Prizes or any component or item thereof;
13.3. the failure of any electronic communications in relation to delivery and/or receipt of entries, postings, winner notifications and other notifications whatsoever; and
13.4. any entry, posting, notification or correspondence that is lost, late,misdirected, intercepted, undelivered, rejected, blocked, deleted or otherwise not received for any reason whatsoever.

14. Under no circumstances shall the inclusion of:

14.1. any Prize offered under the Campaign;
14.2. any product or service offered under the Campaign or related to or connected with any Prize or any component or item thereof,

be construed as an endorsement or recommendation of such Prize or product or service by the MasterCard Group.

15. Under no circumstances shall the appearance of any celebrity in connection with the Campaign in any media whatsoever be construed as an endorsement or recommendation of any MasterCard product or service by such celebrity.

16. No representation or warranty of any kind is given by the MasterCard Group as to the Prizes offered under the Campaign and all liability of any kind whatsoever is excluded to the fullest extent permissible by applicable law. In the event legislation mandates conditions or warranties which cannot be excluded, restricted or modified except to a limited extent, then to the extent permitted by law, the MasterCard Group’s liability is limited to, at its option:

16.1. the replacement of the Prize or any component or item thereof or the supply of an equivalent prize; or
16.2. the payment, if it does not contravene any law, of the cost of the replacement or supply.

17. The providers of the Prizes and the providers/suppliers of any other products and services offered under the Campaign or related to or connected with the Prizes or any component or item thereof are not agents, contractors,employees, servants, consultants or affiliates of the MasterCard Group.

18. All risks associated with the collection, use and redemption of the Prizes and the travel to and from any venues and locations associated with the Prizes shall be assumed by the winners and their companions (if any). The MasterCard Group and their respective directors, officers, employees and agents shall not be liable to the winners or their companions (if any) under the Campaign or any other person for any deficiency, delay, omission or failure related to or connected with Campaign or the Prizes or any component or item thereof.

19. To the fullest extent permitted by applicable law, each Participant shall not have any claim whatsoever against any member of the MasterCard Group andtheir respective directors, officers, employees and agents in respect of anyaction, proceeding, judgment, damage or loss (including, without limitation,incidental, punitive, consequential, special, direct or indirect damages, lossof profits, loss of business, loss of business opportunity or economic loss),expense, injury (including, without limitation, death or personal injury),damage to property or liability suffered or incurred by the Participant(including any companion of the winner) or any other person arising from or inconnection with:

19.1. such Participant’s participation in the Campaign;
19.2. the collection, receipt, redemption, use or misuse of any Prize or anycomponent or item thereof by such Participant and/or any other person; and
19.3. the travel to and from any venues or locations associated with any Prizeor any component or item thereof.

20. Each Participant shall indemnify and hold the MasterCard Group and theirrespective directors, officers, employees and agents harmless from and againstany and all claims (including, without limitation, claims for negligence),liabilities, suits, damages, judgments, costs and expenses (including, withoutlimitation, attorney’s fees) and all losses and expenses resulting or arisingfrom or connected with any claims or actions by any third parties against theMasterCard Group or any entity therein or their respective directors, officers,employees and agents due to any default, act, omission or negligence of suchParticipant, including, without limitation, default in complying with theseterms and conditions or any violation of any applicable law, rules andregulations by such Participant.

21. The MasterCard Group and their respective directors, officers, employeesand agents shall not, to the fullest extent permissible by applicable law, beliable in any way whatsoever in respect of any of the following:-

21.1. lost, late, misdirected, intercepted, undelivered, rejected, blocked ordeleted entries, notifications, postings, correspondences or Qualifying Entrytransaction postings;
21.2. any Prize or any component or item thereof that is damaged, defaced,illegible, lost, stolen or otherwise not used;
21.3. inaccurate information provided by the Participant, howsoever caused;
21.4. the suspension, cancellation or termination of the Campaign for anyreason whatsoever;
21.5. virus or other corruption, technical or mechanical error or failure,human error, negligence or unauthorized human intervention in any part of theentry process, the winners’ selection or determination process, or theoperation or administration of the Campaign;
21.6. technical or mechanical errors related to computers, servers, mobilephones, satellites, telephone lines, network lines or any other equipment;
21.7. non-receipt of entries, notifications, postings, correspondences orQualifying Entry transaction postings; and
21.8. any action, proceeding, judgment, liability, loss, injury, claim ordamage (including, but not limited to, incidental, punitive, consequential,special, direct or indirect damages or losses, loss of profits, loss ofbusiness, loss of business opportunity, economic loss), expense, death andpersonal injury incurred or suffered by any Participant or any other personwhich may be caused, directly or indirectly, in whole or in part, from (i) anyparticipation in the Campaign; (ii) the collection, receipt, redemption, use ormisuse of any Prize or any component or item thereof; or (iii) the travel toand from any venues or locations associated with any Prize or any component oritem thereof.

22. MasterCard's records of all matters related to or connected with theCampaign shall be conclusive and binding on the Participants. MasterCard’s decisionon all matters relating to or connected with the Campaign (including, withoutlimitation, the selection of winners) shall be final and binding on theParticipants.

23. MasterCard accepts no responsibility for any tax implications that mayarise from any Prizes or any component or item thereof or the claiming,redemption and use thereof. Any tax filing obligation or any tax, rates or feepayment due to any authority as a result of the participation in the Campaignby a Participant or the collection, redemption, receipt or use of any Prize orany component or item thereof remains the sole responsibility of the winner thereof. It is the responsibility of each winner to seek independent advice on the possible implications this may have on his/her own financial situation.

24. MasterCard reserve the right to discontinue the Campaign at any time during the Campaign Period and in which case the Participants shall not have any claim whatsoever against MasterCard or the MasterCard Group.

25. Any of these terms and conditions may be changed, varied, modified and/or deleted by MasterCard in its sole and absolute discretion at any time and from time to time without any prior notice to the Participants or to any other person and each Participant irrevocably and unconditionally accepts any such changes, variations, modifications and deletions.

26. The Campaign is subject to all applicable laws and regulations. Without prejudice to the provisions of clause 23 above, in the event MasterCard are prevented from continuing with the Campaign or the integrity and/or feasibility of the Campaign is undermined by any event beyond the control of MasterCard,including, but not limited to, fire, flood, epidemic, earthquake, explosion,labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order, or regulation, order of any court or jurisdiction, infection by computer virus,unauthorized intervention, breakdown in equipment, technical failures or othercause not reasonably within the control of MasterCard, MasterCard shall havethe right, in its sole and absolute discretion, to abbreviate, modify, suspend,cancel or terminate the Campaign without any further obligation.

27. The Campaign cannot be clubbed with any other offer(s) or promotion(s).

28. The Campaign and these terms and conditions will be governed by the laws ofIndia. In case of any dispute in relation to the Campaign, MasterCard’sdecision shall be final and binding.

29. If any of the provisions of these terms and conditions becomes or isinvalid, illegal or unenforceable in any respect under applicable law, thevalidity, legality and enforceability of the remaining provisions shall not inany way be affected or impaired and such invalid, illegal or unenforceableprovisions shall be deemed severed from these terms and conditions and MasterCardshall be entitled to replace such severed provisions with such other provisionsas it may deem fit.
